Darshan misused interim bail granted on medical grounds as he has not undergone surgery, police tell Karnataka High Court
The Bengaluru city police on Friday told the High Court of Karnataka that actor Darshan was not entitled for continuation of interim bail granted to him to undergo surgery for his back pain and that he should be directed to surrender, while alleging that the film star had misused the interim bail as he had not yet undergone surgery.
These submissions were made on behalf of the police before Justice S. Vishwajith Shetty during the hearing on the petitions filed by Darshan, who is accused in the murder of Renukaswamy, and other accused, including actor Pavithra Gowda, who have sought their release from prison on regular bail.
What medical report said
Special Public Prosecutor (SPP) P. Prasanna Kumar told the court that medical reports submitted on behalf of Darshan on November 6, 15, and 21 indicated that he was being “prepared for the surgery” from the day of his admission to hospital.
Pointing out that the court had given six weeks for Darshan to undergo surgery and treatment, the SPP said that there was no indication on conduct of surgery even though it was already five weeks since his release on interim bail.
The SPP said that the actor’s blood pressure (BP), as indicated in hospital’s report, was normal till around November 10 and it showed fluctuation in the rate of 140 thereafter.
BP can’t hinder surgery
This variation in BP could not be a ground for not conducting surgery, said Mr. Kumar, while pointing out that some reputed surgeons had given their opinion stating that BP could be reduced by giving a tablet, which costs only ₹2.20 to prepare the actor for surgery.
The doctors had also made it clear that surgeries could be performed on persons with high BP even during emergencies such as accidents etc., and in such cases the BP was controlled through anaesthesia, the SPP said.
Only physiotherapy
Darshan was merely undergoing physiotherapy since his release and had misused the sympathy shown by the court on the plea that there was a chance of he suffering paralysis if he was not permitted to undergo surgery immediately, pointed out Mr. Kumar.
At this stage, senior advocate C.V. Nagesh, appearing for the actor, told the court that the date for surgery was being fixed now while pointing out that the police had already moved the apex court for cancellation of interim bail.
Meanwhile, Justice Shetty told the SPP that the police could have filed an application before the High Court for cancellation of interim bail instead of waiting for arguments on grant of regular bail.
Report submitted
The medical reports of Darshan was submitted to the court in a sealed cover by his advocates and copies of the reports were given to the SPP on November 21 after a direction from the court. Further hearing was adjourned till December 9.
