No forward movement on 4 names reiterated by collegium headed by CJI Chandrachud
NEW DELHI: There has been no forward movement on the names reiterated by SC collegium headed by Justice D Y Chandrachud for appointment as HC judges as he demits office as the chief justice of India on Nov 10.
The collegium had in Jan 2023 reiterated the names of advocates Saurabh Kirpal for elevation as a judge of the Delhi HC, R John Satyan as judge of the Madras HC, and Amitesh Banerjee and Sakya Sen as judges of Calcutta HC.
The top court collegium had also reiterated the name of Somasekhar Sundaresan, also an advocate, as judge of the Bombay HC in Jan 2023.
In Nov that year, he was elevated as a judge of the Bombay HC. People aware of the procedure to appoint HC and SC judges said the files relating to Kirpal, Satyan, Banerjee and Sen are still pending with govt.
In Jan 2023, the Supreme Court collegium had for the second time reiterated the names of Banerjee and Sen for appointment as judges of the Calcutta HC “expeditiously”, saying it was not open for the govt to repeatedly send back the same proposal.
Advocate Banerjee is the son of former apex court judge Justice U C Banerjee, who headed a commission which in 2006 ruled out conspiracy angle in the 2002 Sabaramati Express fire tragedy at Godhra that killed 58 ‘kar sevaks’.
Advocate Sen is the son of Justice Shyamal Sen, who was elevated as a permanent judge of Calcutta HC in Feb 1986 and later became the chief justice of Allahabad HC. Justice Sen also served as the Governor of Bengal from May 1999 to Dec 1999.
Besides reiterating the names of Banerjee and Sen, the three-judge collegium had also reiterated the names of senior advocate Kirpal as a judge of the Delhi HC, advocate Sathyan as judge of Madras HC and advocate Somasekhar Sundaresan as a judge of the Bombay HC.
Justice Sanjiv Khanna will take over as the next CJI on Nov 11, a day after Justice Chandrachud demits office and will have a tenure of a little over six months. He will retire on May 13, 2025 on attaining the age of 65 years.
